Seaborne Capital, LLC ("Seaborne," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit seabornecap.com, submit information through the website, or otherwise communicate with us in connection with the website.

We refer to seabornecap.com and its related pages collectively as the "Site."

This Privacy Policy applies only to information collected through the Site. It does not apply to websites or services operated by portfolio companies, affiliated entities, or other third parties, even when the Site links to them.

1. Information We Collect

Information You Provide to Us. We may collect information that you voluntarily provide, including:

  • Information contained in pitch materials, presentations, investment materials, or other documents you provide

Please do not submit Social Security numbers, financial account credentials, health information, or other highly sensitive personal information through the Site unless Seaborne has specifically requested it and appropriate protections are in place.

Information Collected Automatically. When you visit the Site, we and our service providers may automatically collect information concerning your browser, device, and use of the Site, including:

  • Internet Protocol address
  • Browser type and version
  • Device type
  • Operating system
  • Pages viewed
  • Links selected and other interactions with the Site
  • Referring website or source
  • Dates and times of visits
  • Approximate geographic location

This information may be collected by our website hosting, security, form-processing, and analytics providers.

Cookies and Google Analytics. The Site uses cookies and similar technologies to operate properly and understand how visitors use it.

We currently use Google Analytics, an analytics service provided by Google, to measure Site traffic and evaluate Site usage. Google Analytics may use first-party cookies and similar technologies to collect information such as session statistics, approximate geographic location, browser and device information, referral source, and interactions with the Site.

Your browser may also transmit information such as the page URL and Internet Protocol address to Google. Google processes this information in accordance with its own terms and privacy practices.

Under our current configuration, we use Google Analytics for measurement purposes only. We do not currently use Google Analytics advertising features, Google Signals, remarketing, or ad personalization.

2. How We Use Information

Service Providers. We may disclose information to vendors that provide website hosting, form processing, analytics, communications, information technology, cybersecurity, data storage, and other operational services. This includes Google in connection with our use of Google Analytics.

Affiliates and Related Investment Entities. We may disclose information to Seaborne-affiliated entities or investment vehicles when reasonably relevant to an inquiry, investment opportunity, financing, partnership, or other business relationship.

Professional Advisers. We may disclose information to attorneys, accountants, auditors, consultants, financial advisers, insurers, and other professional service providers.

Transaction and Business Counterparties. We may disclose information to potential co-investors, lenders, sellers, buyers, or other transaction parties when reasonably necessary to evaluate or pursue a business opportunity, subject to appropriate confidentiality protections where applicable.

Legal and Regulatory Authorities. We may disclose information when required by law, regulation, subpoena, court order, or other legal process, or when we reasonably believe disclosure is necessary to:

  • Comply with a legal obligation
  • Protect Seaborne's rights, property, or interests
  • Protect the safety or rights of another person
  • Investigate fraud, misconduct, or security incidents
  • Prevent unlawful or harmful activity

Business Transfers. We may disclose or transfer information in connection with a merger, acquisition, financing, restructuring, sale of assets, bankruptcy, or similar business transaction or proposed transaction.

4. Sale and Targeted Advertising

We do not currently sell personal information or share personal information for cross-context behavioral advertising, as those terms are defined under applicable United States privacy laws.

We also do not currently process personal information collected through the Site for targeted advertising.

If our practices change, we will update this Privacy Policy and provide any notices or choices required by applicable law.

5. Online Tracking and Your Choices

Browser Controls. Most browsers allow you to delete or block cookies or receive notifications before cookies are stored. Blocking cookies may affect certain Site functionality.

Google Analytics Opt-Out. Google provides a Google Analytics Opt-out Browser Add-on that visitors may use to prevent supported browsers from sending information to Google Analytics.

Do Not Track Signals. Some browsers transmit "Do Not Track" signals or similar requests. Because there is not currently a universally accepted standard for responding to Do Not Track signals, the Site does not currently respond to those signals.

Collection by Other Parties. Third-party service providers, including Google, may collect information through cookies or similar technologies when you visit the Site. Depending on their services, technologies, and your account or device settings, those providers may be able to recognize your browser or device over time or across different websites and services. Their collection and use of information are governed by their respective terms and privacy practices.

6. Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy.

The appropriate retention period depends on factors including:

  • The type and sensitivity of the information
  • The nature of our relationship with you
  • The reason the information was collected
  • Whether the information relates to an investment or business opportunity

Google Analytics information is retained in accordance with our Google Analytics configuration and Google's applicable retention practices.

When information is no longer reasonably necessary, we may delete, anonymize, or securely retain it as required by law.

We use reasonable administrative, technical, and organizational measures designed to protect personal information under our control.

However, no website, internet transmission, electronic storage system, or security measure can be guaranteed to be completely secure. You should use appropriate care when deciding what information to submit electronically.

  • Request access to personal information we maintain about you

These rights are not absolute and may be subject to exceptions under applicable law.

We may request information reasonably necessary to verify your identity and process the request. An authorized agent may submit a request where permitted by law, but we may require verification of the agent's authority.

If applicable law gives you a right to appeal our decision, you may submit an appeal to legal@seabornecap.com with the subject line "Privacy Appeal."

Where the Delaware Personal Data Privacy Act applies, Delaware residents may also contact the Delaware Department of Justice at privacy@delaware.gov regarding an unresolved privacy complaint.

9. International Visitors

Seaborne is based in the United States. Information collected through the Site may be processed or stored in the United States and other countries where Seaborne or its service providers operate.

Those countries may have privacy laws that differ from the laws in your country of residence.

Where required by applicable law, we will rely on an appropriate legal basis for processing and transferring personal information.

10. Children's Privacy

The Site is intended for a general business and investment audience and is not directed to children or minors.

We do not knowingly collect personal information from children through the Site. If we learn that a child has submitted personal information, we will take reasonable steps to delete it.

11. Third-Party Websites

The Site may contain links to portfolio companies, affiliated organizations, publications, social media platforms, and other third-party websites.

Seaborne does not control and is not responsible for the content, security, availability, or privacy practices of third-party websites. You should review the privacy policies of those websites separately.

We may update this Privacy Policy to reflect changes to our practices, technologies, legal requirements, or the Site.

When we update the Policy, we will post the revised version and change the "Last Updated" date above. If changes are material, we may provide additional notice through the Site or another appropriate method.
